1. PURPOSE OF THE GENERAL TERMS AND CONDITIONS


1.1 These general terms and conditions of sale (General Terms and Conditions) regulate the sale by Coin S.p.A. (Coin) of products (Products) to customers (Customers) through the website www.coin.it ( Site).

1.2 You may only purchase and receive Products if you reside or are domiciled within the European Union and are of legal age.

1.3 Products consisting of furniture, furnishings and Christmas trees are shipped only within the Italian territory. Therefore, it is not possible to purchase them if the place of delivery is outside the Italian territory.

1.4 For any information on these General Terms and Conditions and/or your purchases, you may contact the customer service (Customer Service) of Coin.


2. SALE OF PRODUCTS


2.1 The information and details concerning the Products sold through the Site are not offers of sale.

You may submit proposals for the purchase of Products (Orders) by filling in the electronic order form available on the website, by means of which you may choose from the various options indicated (e.g. whether you would like an invoice, delivery, transport and payment terms).

Once you have completed your Order, you can send it by selecting the 'proceed to payment' button.

A page summarising the Order will then be displayed and you will receive an e-mail in which Coin confirm receipt of the Order, which will be considered as a contractual proposal of purchase regulated by these General Terms and Conditions.

2.2 Your Order will only be accepted and then you will have concluded a contract of sale with Coin or the Seller when a further, separate email is sent confirming that the Order is accepted and in progress (Order Confirmation). The contract will only be concluded for the Products expressly indicated in the Order Confirmation.

2.3 Coin or the Seller reserve the right, at their sole discretion, not to accept Orders . For example, Orders will not be accepted if:

- the data provided by the Customer when filling in the order form are incomplete or incorrect;

- the Customer does not qualify as a consumer or does not meet the requirements to fulfil the payment terms;

- the Products ordered are not available, in which case neither Coin nor the seller shall be held liable ;

- the shipment of Products outside the European Union or the shipment of furniture, furnishings and Christmas trees outside Italy is requested.

If the Order is not accepted, Coin or the Seller will inform you by e-mail and any payments already made will be refunded.

We cannot exclude the possibility that the Products indicated in the Order Confirmation may not be available in some cases; you will be notified by email and any payments already made will be refunded.


3. PRICES AND PAYMENT


3.1. The sale prices of the Products are expressed in Euro and the payment methods are set out on the Site.

Prices include VAT but not shipping costs and any additional costs such as assembly services, which will be quantified before the Order is placed and will be added to the total amount due.

The prices shown on the Site may be changed at any time; in any case, price changes will not apply to Orders already placed by the Customer.

In the case of crossed-out prices, the original crossed-out price is the list price. The non-crossed out price is the sale price, following the application of the indicated percentage of discount.

3.2 You may pay the price of the purchased Products in the following ways:

- Online credit card: payment by Visa, Mastercard, American Express,

Maestro, Diners.

Credit card payments are handled directly by Adyen's secure servers, which, thanks to the use of card data encryption and in accordance with the secure communication guaranteed by the TLS 1.2 protocol, guarantees the security of online transactions. This is why Coin and the

Seller are not aware of the Customer's credit card data.

Upon receipt of the Order, Coin or the Seller will make a pre-authorisation request on the Customer's credit card to ensure that the Customer has sufficient funds to complete the transaction.

Credit cards will be subject to verification and authorisation by the credit card issuer. Coin and the Sellers shall not be liable for any failure to obtain authorisation from such entity.

Once the sales contract is concluded by sending the Order Confirmation, the credit card charge will be final, subject to your right of withdrawal and the legal guarantee on the Product.

- Amazon Pay

- Klarna Pay Over Time (only for deliveries of Products in Italy)


Only for products sold by Coin, it is also possible to pay with

- PayPal

- Coin Giftcard: if you have a Coin Giftcard you can use it for full or partial payment of the price of Products; you must have registered on the Site and associated the Coin Giftcard to your profile. Once associated, the Coin Giftcard cannot be transferred to other accounts. The Coin Giftcard cannot be used to purchase other Coin Giftcards.

- Cash on delivery: payment is permitted only for Products delivered within the Italian territory, within the limit of Euro 999.00. Payment shall be made in cash by the Customer upon delivery of the Products.

- Scalapay

- Dedicated POS, Maestro or VPay-enabled debit card: only in the case of orders placed in service-enabled Coin stores via the dedicated App.




4. SHIPPING AND DELIVERY OF PRODUCTS. ASSEMBLY SERVICE


SHIPPING AND DELIVERY


4.1 The Products will be delivered to you in accordance with the delivery times and methods indicated in the delivery service you have chosen in the Order. Delivery times are purely indicative and cannot be totally relied upon.

Upon delivery, you will be asked to sign a delivery document (Delivery Document) which proves that you have received the Products purchased. If the Delivery Document is signed by a person other than the Customer, delivery is considered made to the Customer.

4.2 The delivery methods are different for Coin and each Seller: to see them, please consult the Coin Page (Shipment) or the Seller Page accessible via the link on the page of the Product you wish to purchase .


4.3 The following terms and conditions of shipment apply only to the Products sold by Coin:

4.3.1 For Products other than furniture and furnishing accessories, you can choose the "Click and Collect" delivery method. You may collect the Products purchased at one of the Coin shops of your choice, as listed on the Site.

Delivery by Click and Collect is free of charge, unless otherwise indicated on the Site.

We will inform you by e-mail of the date from which the Products will be available for collection at the shop of your choice.

In the event of non-collection after 30 days from that date, the Products will no longer be available and the

Customer shall not be entitled to any reimbursement.

4.3.2 If you have chosen shipment to the address indicated by you in the Order, you will be charged with transport costs; they will be quantified before the Order is sent and may vary depending on the delivery service chosen, the quantity of Products purchased and any promotions valid at the time of the Order.

We will notify you by email of the shipment; you can check the status by following the instructions in the email - except for Heavy Transport shipments as specified below.

Shipping is carried out:

- on the Italian territory, for all types of Products

- in the other countries belonging to the European Union, exclusively for Products other than furniture, furnishings and Christmas trees. It will therefore not be possible to order such types of Products for delivery outside the Italian territory.

4.3.3 Shipment may take place in two different ways:

4.3.3.1 "Light Transport": only for Products other than furniture and furnishings.

The Products will be shipped by courier.

Shipment is expected within 3-5 working days from Order Confirmation. Express shipment is not available.

Delivery will take place without prior appointment and will be at street level, between 8 a.m. and 7 p.m. Monday to Friday.

4.3.3.2 "Heavy Transport": only for furniture and furnishings.

a) The Products will be shipped via a specialized carrier. In order to guarantee the best possible service, Coin may use different carriers depending on the geographical area of destination.

The estimated delivery time for furniture and furnishings is approximately 20 working days from Order Confirmation. For shipments by Heavy Transport it is not possible to check the status of the shipment.

Near the earliest possible date for delivery, the Customer will be contacted directly by the carrier to agree on the time slot and the day on which delivery of the Products will be made.

In the event of the customer's absence on the day and time agreed with the carrier, the cost of the new delivery will be charged to the Customer.

b) The cost of any additional services necessary to carry out the delivery of the Products shall be borne by the Customer. 

Additional services include the following:

- the Delivery is requested in areas where traffic is subject to restrictions and/or prohibitions, such as, but not limited to, restricted traffic zones, zones with restricted access to motor vehicles, pedestrian zones, etc.;

- the distance between the point of unloading and the delivery address of the Products is greater than

100 (one hundred) meters;

- the place of delivery of the Products does not have a lift, freight lift, or in any case a staircase and/or doors of a size and capacity suitable for the passage and lifting of the Products;

The Customer is obliged to indicate in the Order the need for any additional services for the delivery of the Products. Failing this, Coin may not be able to complete the delivery of the Products on time, and may have to make additional deliveries, which will be charged to the Customer.

In addition, the carrier may charge the Customer for additional services not notified in advance and necessary to complete the delivery. The Customer may also request the additional services directly from the carrier at the time of contact to agree on the day and time of delivery. In the event that these additional services are not among those provided on the Site, the Customer shall make the appropriate arrangements directly with the carrier.

c) In the event of refusal of delivery or if the carrier is unable to contact the Customer within 5 days after the first attempt (for reasons attributable to the Customer), the order will be automatically cancelled and Coin will reimburse the Customer for the value of the order, with the exclusion of the shipping costs, storage and return of the goods, which shall remain the responsibility of the Customer.

The Products purchased may remain in storage at the "pick-up point" communicated by the Carrier, at no additional cost, for a maximum of 15 (fifteen) days from the day on which the Customer was contacted (or attempted to be contacted) to communicate their availability for collection. After fifteen days of storage, the Carrier shall charge the Customer the cost of EUR 5.50 (five/50) in total (including VAT) for each additional day of non-collection. The storage period shall in any case have a maximum duration of 30 (thirty) days.

These amounts, if any, must be paid directly to the operators at the collection point.

4.3.4 In the case of mixed Orders containing at least one piece of furniture or furnishing accessory, Products not belonging to that category shall be shipped by Light Transport. The Customer may therefore receive the purchased Products in more than one shipment.

4.3.5 If you purchase a Coin Giftcard, it will be delivered to you exclusively in electronic format, to the email address you have indicated in the Order.

4.3.6 Coin shall be exonerated from liability in the event of delays caused by events, acts, facts and circumstances unforeseeable at the time of Order Confirmation, unavoidable and beyond the control of Coin (by way of example: strikes, riots, natural disasters, restrictions imposed by the authorities etc.).


4.4 In the event of Orders containing both Products sold by Coin and Products sold by one or more Sellers, you will receive two or more separate deliveries.


ASSEMBLY SERVICE


4.5. The "Assembly Service" is a paid service, applicable only to Products in the category

"furniture" (as identified on the Site) sold by Coin, which you can request in your Order. The Assembly Service will be provided directly by the carrier upon delivery of the Products. The costs of the Assembly Service will be borne by you and will be quantified before sending the Order

4.6 In order to perform the Assembly Service, the Customer shall:

- make the premises fit for installation (e.g. by clearing the premises and flooring; making any coverings complete and clean; presence of available electricity; minimum width of the entrance door; minimum manoeuvring space in front of the door,

etc....);

- be present during the execution of the assembly and indicate on the document "Report of

Delivery' any anomalies found;

- report on the Delivery Report any damage to property (objects, walls, parquet flooring,

etc.) of the Customer's property that occurred during assembly.

4.7 The Assembly Service does not include the connection and/or disconnection of electricity, gas and water supplies.

4.8 Please note that furniture may not be fixed to partitions made of lightweight concrete, plasterboard, siporex, wood, tuff, gasbeton, fermacell (pressed newsprint) and the like.

4.9 The costs for the Assembly Service shall be borne by the Customer and adequately highlighted in the Purchase Order and in the subsequent order confirmation.



5. RIGHT OF WITHDRAWAL


5.1 You may withdraw from the contract concluded with Coin or a Seller and return the Products purchased, within 14 days (Term) from the date of the Delivery Note signed upon delivery of the Products. 

In the case of delivery of Products ordered in one Order but delivered separately, the Term runs from the date of the Delivery Document signed upon delivery of the last Product.

5. 2 To exercise the right of withdrawal, you must inform Coin or the Seller, within the Term, by making an express declaration of withdrawal (Declaration of Withdrawal). To make the Declaration of Withdrawal you may proceed as follows:

Registered user: Log in to your account and from your personal area click on "my orders" and go to the order for which you wish to request a return.

Non-registered user: From the shipping confirmation email click on the link: "Check your order summary here ".

- select the products to be returned and follow the on-screen instructions ;

- for products sold by third-party sellers, follow the instructions in the 'shipping and return' section of the Seller's page.

You will be sent an email confirming receipt of the Declaration of Withdrawal (the same will be forwarded to the Seller for products not purchased from Coin) with instructions on how to proceed with the return.



6. EFFECTS OF WITHDRAWAL: TIMING AND MODALITIES FOR THE RETURN OF PRODUCTS AND REIMBURSEMENT OF THE PRICE


6.1 If you make a Declaration of Withdrawal, you will be refunded the payments made for the purchase of the Products net of any discounts and/or promotions, including delivery costs (except in the cases specified below ), no later than 14 days from the date on which Coin or the Seller receive the returned products. The reimbursement may be suspended until receipt of the Products, or until the Customer proves that they have been returned.

6.2 You can consult the procedures and times for the return of Products you purchase from Sellers on the Seller's Page, accessible via the link found on the page of the Product purchased. 


6.3 The return of the Products you purchase from Coin can be made in the following ways:

a) by means of a courier selected by the Customer, in which case the shipping costs shall be borne by the Customer;

b) by a courier contracted with Coin, in which case the return will be free of charge. 

c) by returning the Products to one of the Coin shops indicated on the Site.

 For this purpose, you will need to present the printout of the e-mail of Confirmation of receipt of Declaration of Withdrawal to the shop. If the Products are returned to the shop, the Customer shall not be reimbursed the shipping costs of the Products, but only the price of the Products. It is not possible to request the shop to exchange the returned Products.

The Products consisting of furniture, furnishing accessories and Christmas trees cannot be returned to the shops and the shipping costs will always be borne by the Customer, even in the event of return by a forwarding agent contracted with Coin.

The Products must be returned in a single shipment or delivery. Coin reserves the right not to accept the return of Products that are part of the same Order returned at different times.


6.4 In order to obtain a refund of the payment made for the purchase of the returned Products, the Products must be intact and therefore: they must not be broken or damaged; they must not have been used, worn, washed; they must still have the identification tag and the various labels of composition and washing, possibly with the disposable seal; they must be in their original packaging, complete in all their parts (including packaging and accessory documentation). Coin will not make any reimbursement in the event that the Products returned are not intact as described above. 


6.5 If the Declaration of Withdrawal has been exercised within the Term and the Products have been returned in the manner and under the conditions requested above, we will send you an email confirming reimbursement of the payments made for the purchase.


6.6 Refunds will be made using the same payment method used by the customer for the initial transaction, unless otherwise expressly agreed with Coin.

If the customer has made the payment using the cash on delivery method (article 3.2), the reimbursement will be made by bank transfer to the bank account indicated by the customer.

For orders paid for with Giftcard Coin or mixed payment (Giftcard Coin + other payment method), the amount paid with Giftcard Coin will be returned by issuing a new giftcard - charged with the value corresponding to the value of the returned amount paid by giftcard - which will be sent to the email of the person who placed the order. The corresponding activation code will be sent to the same email. In fact, the Coin Giftcard does not give the right to cash refunds, as explained in the relevant General Terms and Conditions of Use .  

Refunds of orders paid for by means of Coin Giftcard or Cash on Delivery will be handled by Customer Service, even if the return is made at one of the authorised Coin, Coin Excelsior or Coincasa shops. 

The reimbursement of Products returned to one of the authorised Coin, Coin Excelsior or Coincasa shops will take place in the same manner as the reimbursement of Products returned via the online form.

6.7. In any event, the Customer shall bear no costs for the refund.

6.8 If there is no correspondence between the addressee of the Products indicated in the order and the person who made the payment due for their purchase, reimbursement shall be made in any event to the person who made the payment

6.9 Under no circumstances is it possible to exchange - either online or in-store - Products purchased online. Should the customer wish to exchange the purchased product, he/she shall have to return it and request a refund, and then either place a new order online or make a new purchase in shop.



7. PRODUCT FEATURES - ASSISTANCE AND LEGAL GUARANTEE


7.1. The Products displayed on the Site are Products owned by Coin or the Seller or other Products legitimately sold by Coin or the Seller. 

The characteristics of each Product are listed on the Site within each 'product sheet', which also indicates whether the seller is Coin or another Seller. 

Certain characteristics (such as colour, finish, size, etc.) may not perfectly correspond to the real ones due to the resolution of the device used and the transmission of data via the Internet.

7.2 For any after-sales service related to the Products you purchase from a Seller, you may contact the Seller's Customer Service Department free of charge, as indicated on the Seller's Page, which you can consult through the link on the page of the Product you wish to purchase.

For any after-sales assistance relating to Products you purchase from Coin, you can contact Coin Customer Service free of charge using the form available in the www.coin.it/SERVIZIOCLIENTI area.

If you believe that the Products purchased are defective, you may request a refund as described in Section 5.2 by selecting the reason 'defective'. You will be asked to attach photos proving the defect. For other requests, you can use the form available in the www.coin.it/SERVIZIOCLIENTI area of the Site and follow the instructions provided. Do not send defective Products to return them, but follow the instructions given. For Products consisting of furniture, furnishing accessories and Christmas trees, Coin may organize collection at its own expense.


7.3 If you are a consumer, you are entitled to the legal guarantee of conformity (Legal Guarantee). The Legal Warranty guarantees the Product against defects in conformity with the sales contract that occur within two years from the date of the Delivery Document. The Legal Warranty entitles you to have the Product's conformity restored free of charge by repair or replacement, or, if this is not possible, to an appropriate reduction of the purchase price or to termination of the contract.

7.4 The Legal Warranty is provided by Coin or the Seller of the Product; Coin does not provide the Legal Warranty for Products sold by other Sellers. 

7.5 Under penalty of forfeiture of the Legal Warranty, you shall report the lack of conformity to the Seller within two months of its discovery.

8. PROTECTION OF PERSONAL DATA 


The Customer's personal data will be processed in accordance with the regulations in force as indicated

(i) to the extent applicable to the individual Seller, in the privacy policy published on the Seller's page which you can access via the link on the page of the Products sold by each Seller;

(ii) as far as Coin is concerned, in the privacy policy of the www.coin.it website and in the specific information on the processing of personal data that will be provided to the Customer, from time to time, when collecting the data.



9. APPLICABLE LAW AND DISPUTE RESOLUTION


9.1 The General Conditions and the contracts for the sale and purchase of Products are governed by Italian law.


9.2 For any dispute concerning the validity, interpretation, termination or execution of these

General Terms and Conditions and contracts for the sale and purchase of Products, the territorial jurisdiction shall lie with the courts of the place of residence or domicile of the Customer.


9.3 Netcomm Joint Conciliation. In the event of a sale made by Coin or by Sellers adhering to Netcomm, the Customer, pursuant to article 49 paragraph 1 letter V of Legislative Decree 6 September

2005 No. 206 (Consumer Code), may make use of the Joint Conciliation Procedure (Procedure).

The Procedure may be initiated if the consumer, after submitting a complaint to Coin or the Seller within 45 days, has not received a response or has received a response that is not satisfactory to him.

9.4 ODR - European platform for online dispute resolution

Pursuant to Article 14 of Regulation 524/2013, the customer in the event of a dispute may

submit a complaint via the EU ODR platform available at the following link

http://ec.europa.eu/consumers/odr/. The ODR platform provides an access point for users who

wish to settle out-of-court disputes arising from sales or service contracts

10. REVISION CLAUSE


These General Terms and Conditions may be revised at any time. The new version will be published on the Site replacing the previous version. The new version will only apply to contracts concluded after its publication on the Site. The Site may also be amended at any time, at its sole discretion, in any way and/or at any time without prior notice.
